Blue badge holders have special parking rights across the UK, but mistakes happen — a badge slips off the dashboard, the clock is set incorrectly, or a CEO doesn't check properly. If you've received a parking ticket despite being a valid blue badge holder, here's how to challenge it.

Common Reasons for Blue Badge Parking Fines

Badge Not Displayed

This is the most common issue. The badge may have slipped off the dashboard, been knocked down by a passenger getting out, or been placed face-down by mistake. If you had a valid badge in the vehicle but it was not visible to the CEO, you will typically receive a PCN. However, this is often successfully appealed — see the defence section below.

Clock Not Set or Set Incorrectly

The parking clock must be displayed alongside the badge, set to the nearest quarter-hour of your arrival time. If the clock was missing, not set, or set to the wrong time, a CEO may issue a PCN. Common scenarios include forgetting to change the clock from a previous trip, or setting it to the wrong quarter-hour.

Exceeded the 3-Hour Limit

On yellow lines and in disabled bays with time limits, blue badge holders are limited to 3 hours. If you exceeded this, the PCN may be technically valid — though if the overstay was caused by a hospital appointment overrunning or similar circumstances, this should be raised as a mitigating factor.

Parked Where Blue Badge Doesn't Apply

Blue badge concessions do not apply everywhere. Common exceptions include red routes (in London), some private car parks, bays suspended for roadworks, and certain restricted zones. Always check local signage. The London Congestion Charge exemption for blue badge holders also requires separate registration with TfL.

How to Appeal a Blue Badge PCN

"Not Displayed" Defence

If you had a valid blue badge in the vehicle but it was not visible, make an informal challenge to the council. Provide:

Many councils have a policy of cancelling first-time "badge not displayed" PCNs where the badge was valid. This is discretionary, not guaranteed — but it is common practice. If the council refuses, you can escalate to the Traffic Penalty Tribunal, where adjudicators often take a sympathetic view.

"Expired Badge" Defence

If your badge had expired but your renewal was pending (badges are renewed every 3 years), provide evidence of your renewal application. Some councils will cancel PCNs where the driver had a valid disability and was simply waiting for a new badge. Provide your renewal application confirmation and any correspondence with the issuing council.

Passenger Left the Vehicle

The blue badge can only be used when the badge holder is being dropped off, picked up, or is in the vehicle. If the badge holder was dropped off at a shop while the driver went to park elsewhere, the badge should not have been displayed. However, if the badge holder was in the vehicle when it was parked and the driver was assisting them, the badge use is valid.

Blue Badge on Private Land

Blue badge concessions are primarily statutory rights that apply on public roads enforced by councils. On private land (including supermarket car parks, hospital car parks, and other private sites), the operator's own terms apply. Many private operators do honour blue badges, but they are not legally required to offer the same concessions. Check the signage at the specific car park.

Time Limits for Your Appeal

The standard time limits apply. You have 28 days to challenge the council informally, 28 days to make a formal representation after receiving a Notice to Owner, and 28 days to appeal to the tribunal after a Notice of Rejection. Act promptly — your blue badge defence is strongest when raised early.
