POPLA Appeal Guide — How to Win Your Independent Appeal

POPLA (Parking on Private Land Appeals) is the independent appeals service for private parking charges issued by BPA member operators. It's free, impartial, and — if you know how to present your case — remarkably effective. This guide explains everything you need to know.

What Is POPLA?

POPLA is an independent body that resolves disputes between motorists and private parking operators who are members of the British Parking Association (BPA). It was established as part of the BPA's Approved Operator Scheme. If a BPA member operator rejects your initial appeal, you have the right to escalate to POPLA for an independent review.

POPLA only handles appeals against BPA members. If the operator is a member of the International Parking Community (IPC) — such as APCOA — appeals go to the Independent Appeals Service (IAS) instead. Check the operator's trade association membership on your charge notice.

Who Can Appeal to POPLA?

You can appeal to POPLA if:

You cannot go directly to POPLA — you must appeal to the operator first. This is different from council PCNs, where you can also go through a formal representation process before reaching the Traffic Penalty Tribunal.

How to Submit Your POPLA Appeal

  1. Go to the POPLA website and enter your appeal code (provided in the operator's rejection letter)
  2. Complete the online form — you'll need to provide your details, the charge reference, and your grounds for appeal
  3. Upload evidence — photographs, correspondence, receipts, or any other supporting documents
  4. Write your statement — this is the most important part. Be clear, factual, and specific about why the charge should be cancelled
  5. Submit — the operator will then have the opportunity to respond to your appeal

What Do POPLA Assessors Look For?

POPLA assessors evaluate appeals based on several key factors:

Inadequate Signage

The BPA Code of Practice requires clear, prominent signage at the car park entrance and throughout the site. If signs were too small, poorly positioned, obscured, or did not clearly state the terms and the consequences of breach, this undermines the operator's case. Photograph the signage and include it with your appeal.

Defective Notice to Keeper

If the NTK was late, incomplete, or sent to the wrong address, keeper liability has not been established under POFA. This is a technical but powerful defence — the operator must comply strictly with the statutory requirements.

ANPR Evidence Issues

If the operator relies on ANPR camera evidence but cannot provide clear, legible photographs showing your vehicle's entry and exit, the evidence of the contravention is insufficient. Request the ANPR images and scrutinise them carefully.

Genuine Mitigating Circumstances

A hospital appointment overrunning, a supermarket visit where you were a genuine customer, or a mechanical breakdown can all constitute valid mitigating circumstances. Provide evidence to support your account.

POPLA Success Rates

POPLA does not publish detailed success rates, but available data suggests that a significant proportion of appeals are upheld — particularly where the motorist provides clear evidence and well-structured arguments. Appeals that focus on procedural failures (NTK defects, signage issues) tend to have higher success rates than those based purely on mitigating circumstances.

Importantly, there is no downside to appealing to POPLA. If you lose, you simply owe the original charge amount — it cannot be increased as a result of the POPLA process. While the appeal is pending, the operator must not pursue debt recovery.

After the POPLA Decision

If POPLA finds in your favour, the operator must cancel the charge. If POPLA finds against you, the operator may continue to pursue payment.
